Schon früh erhält er Publikationsverbot, 1976 wird er verhaftet und ins Stasi-Gefängnis Berlin-Hohenschönhausen gebracht, 1977 nach West-Berlin abgeschoben. Dort engagiert er sich weiter, hält Kontakt zur Bürger- und Friedensbewegung in der DDR, setzt sich in seinen Werken mit seiner Verfolgung und der dogmatischen und inhumanen Gesellschaft auseinander. Damit steht er auch im Westen wie kaum ein anderer im Visier des MfS und ist zahlreichen "Zersetzungsmaßnahmen" ausgesetzt. Nach dem Mauerfall bemüht sich Fuchs um Aufklärung der Stasi-Verbrechen. 1999 stirbt er mit nur 48 Jahren an Leukämie.
