The case arose after transgender student-athletes—including Becky Pepper-Jackson in West Virginia and Lindsay Hecox in Idaho—challenged state laws requiring athletes to compete according to their biological sex. Writing for the majority, Justice Brett Kavanaugh argued that states may preserve women's sports for biological females and determine eligibility based on biological sex, while Justice Ketanji Brown Jackson, in dissent, argued that excluding transgender women from women's sports still constitutes discrimination "on the basis of sex."
